Justification for data waiving:

the study does not need to be conducted because the organic substance contains oxygen or halogen atoms which are chemically bonded only to carbon or hydrogen and hence, the classification procedure does not need to be applied

Justification for type of information:

Oxidising substances are substances, while themselves not necessarily combustible, may, generally by yielding oxygen, cause, or contribute to the combustion of other material. While test methods exist, testing is not necessary if:

(1) the substance is explosive, or
(2) the substance is highly flammable, or
(3) the substance is an organic peroxide, or
(4) the substance is incapable of reacting exothermically with combustible materials, for example on the basis of the chemical structure (e.g. organic substances not containing oxygen or halogen atoms and these elements are not chemically bonded to nitrogen or oxygen, or inorganic substances not containing oxygen or halogen atoms).

Based on the above rules for adaptation of the standard information requirement for oxidising properties, the test substance is assessed in a tiered approach:

Firstly, if available, information on whether the substance is explosive or highly flammable is assessed. If evidence is available that the substance is explosive or highly flammable, testing for oxidising properties does not need to be conducted.

Secondly, the chemical structure of the substance is assessed. If the substance is an organic peroxide testing does not need to be conducted. If the substance is an organic substance not containing oxygen or halogen atoms or the organic substance contains oxygen or halogen atoms and these elements are not chemically bonded to nitrogen or oxygen (i.e. these elements are chemically bonded only to carbon or hydrogen), or an inorganic substance not containing oxygen or halogen atoms, testing does not need to be conducted. As part of this assessment it has to be verified that the chemical groups associated with oxidizing properties are not present in the molecule.

From the structural formula of the test substance, it can be concluded that the substance is not an oxidising substance. The substance does not have the functional groups associated with oxidising properties. The oxygen present in the molecule is linked to carbon and hydrogen atoms only.

Therefore it can be concluded beyond reasonable doubt that test substance is incapable of causing fire or enhance the risk of fire when in contact with combustible material. As such further testing is not needed.
